Trondheim municipality and Søbstad AS entered into a contract in September 2023 for a turnkey contract for Fredlybekken, where the original specified execution method for the No-dig works was controlled drilling. As a result of demanding, unforeseen ground conditions, the method was initially tried to change to pilot pipe drilling at the start of 2026. Despite extensive ground surveys and thorough technical assessments using the builder, turnkey contractor, sub-contractors, consultants and external experts in the field, none of the chosen methods have succeeded in establishing the wastewater pipe. To ensure that the pipeline installation is completed in accordance with the contract function requirements, it is necessary to change the execution method to micro tunnelling with a closed front for the remaining No-dig works for the establishment of the wastewater pipeline. The change is assessed as permitted in accordance with the Supply Regulations § 24-1 first section letter d as the following three terms are met: The amendment is necessary: The method change to tunnelling is strictly necessary for the contracting authority to fulfil the contract ́s purpose and ensure planned functionality for the surface water and waste water pipelines. To ensure that the costs of the change are kept at a necessary and competitive level, the contractor has completed a competition for the tunnelling. Unforeseen circumstances and vigilant contracting authorities: The need for the change is due to ground conditions that the careful contracting authority cannot foresee when the contract is signed. Thorough ground surveys were carried out in different formats, both before the start-up and during the project. The extent of the unforeseen, inhomogenous landslides and blockstones in the ground, however, it was not possible to uncover until the work started. The procurement ́s overall character does not change: The amendment only applies to the technical execution method for a part of the No-dig route. The main service, the purpose of the contract, the distribution of responsibility and risk remain unchanged. The terms in the utilities regulations § 24-1 first section letter d are fulfilled. The amendment will be announced in accordance with the Utilities Regulations § 24-1 third section, cf. § 17.1.
