Landsnet intends to enter into a negotiated procedure without prior call for competition with Hyosung Heavy Industries for the modifications to the substation at Bakki in Húsavík, pursuant to Article 53(1)(c) of Regulation No. 340/2017, on the basis that competition is absent for technical reasons and that no reasonable alternative or substitute is available in the circumstances. The technical solution for the required modifications is closely linked to the existing substation design recently developed and delivered by Hyosung. By engaging Hyosung, Landsnet can reuse and adapt this existing design and make use of Hyosung’s existing technical knowledge of the solution, thereby avoiding the need for another supplier to undertake a separate design process before equipment manufacture and implementation can commence. This is of particular importance in light of the required connection date of 1 April 2028. Landsnet only received sufficiently definite information regarding the connection requirement and its timing in September 2026. Based on Landsnet’s project schedule, an alternative procurement route involving a separate procurement of engineering design, completion of that design and a subsequent competitive procurement of the equipment would require approximately 32–36 months and would therefore not enable Landsnet to meet the required connection date. Hyosung has, in addition, agreed to give the project priority in its production schedule. The combination of reusing and adapting the existing technical design and commencing the manufacturing process without the additional design and procurement stages provides a materially shorter implementation route and a basis for meeting the required connection date. Against this background, Landsnet considers that no reasonable alternative or substitute is available that would meet the technical requirements within the available implementation period. The proposed direct award to Hyosung is therefore based on the specific technical circumstances of the project and the absence of a reasonable alternative, rather than on an artificial restriction of the procurement requirements.
